To be President, not only must you be a citizen, but you must also be natural-born.

The 14th Amendment defines citizenship this way: "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside." But even this does not get specific enough. As usual, the Constitution provides the framework for the law, but it is the law that fills in the gaps.

Currently, Title 8 of the U.S. Code fills in those gaps. Section 1401 defines the following as people who are "citizens of the United States at birth:"



Anyone born inside the United States

Any Indian or Eskimo born in the United States, provided being a citizen of the U.S. does not impair the person's status as a citizen of the tribe

Any one born outside the United States, both of whose parents are citizens of the U.S., as long as one parent has lived in the U.S.

Any one born outside the United States, if one parent is a citizen and lived in the U.S. for at least one year and the other parent is a U.S. national

Any one born in a U.S. possession, if one parent is a citizen and lived in the U.S. for at least one year

Any one found in the U.S. under the age of five, whose parentage cannot be determined, as long as proof of non-citizenship is not provided by age 21

Any one born outside the United States, if one parent is an alien and as long as the other parent is a citizen of the U.S. who lived in the U.S. for at least five years (with military and diplomatic service included in this time)

A final, historical condition: a person born before 5/24/1934 of an alien father and a U.S. citizen mother who has lived in the U.S.

A foreign-born Prez? Could happen
Proposed constitutional amendments that would allow foreign-born citizens such as the action-movie star to become president will be debated in Congress this autumn.

One of the proposals, by Schwarzenegger political friend Sen. Orrin Hatch, R-Utah, would allow anyone who has been a U.S. citizen for 20 years and has resided in the country for 14 years to be elected president. Hatch denies that he proposed the amendment on July 10 with Schwarzenegger in mind, but it turns out that the 56-year-old actor-businessman was naturalized in 1983.

The other proposal, by a bipartisan group in the House whose ranks include conservative Rep. Darrell Issa, R-Calif. - who spent more than $1.5 million to put the recall election on the Oct. 7 ballot - would allow anyone who has been a naturalized citizen for 35 years to be eligible to become president. The House legislation, whose co-sponsors include liberal Rep. Barney Frank, D-Mass., was proposed long before the recall movement blossomed in California.

World Marvels at Schwarzenegger's Victory
Many at the Tuesday and Wednesday celebrations say they are even convinced that Schwarzenegger also has chances of becoming U.S. president one day if he sets his mind to it and the constitution is changed to allow foreign-born Americans to run.

"If they ever change the constitution, it would be for him,'' [Frank] Bogen said.

RIAA gestapo tactics finally start
The first part of this article by Douglas Wolk is the standard "how to avoid getting sued" spiel. Jump down 4 or 5 paragraphs for the good stuff:

'RIAA agents, backed up by police, have started to raid Midwestern record stores that carry DJ mixes. On September 23, Berry's Music in Indianapolis, Indiana, was raided; according to proprietor Alan Berry, police confiscated $10,000 worth of mix discs by the likes of DJ World and DJ Paul Bunyan.

'City Music, also in Indianapolis, was raided the following week. "They came in and took anything that was on a recordable CD," manager Jerome Avery says. "The only DJ mixes I had were behind the counter for personal listening, and they confiscated them. How can it be illegal if the artist is making them for the street? They came without a notice—no warrant, no nothing. They're making up their own laws, if you ask me."

'"The record labels want the independent record stores out of the business," Berry says. "They'd rather deal with Target, Best Buy, Circuit City—it's consolidation, just like any other industry. The RIAA knows that mixes are an integral part of urban stores' culture and profit margin. By eliminating them, they can eliminate a lot of indie stores."'

EFF: "Who Controls Your Computer?"
The EFF has published a very good report on trusted computing, "Trusted Computing: Promise and Risk", by Seth Schoen. (Edward Felton from freedomtotinker.com said here "it gives the best simple introduction to trusted computing technologies that I have seen".)

(From the EFF's news item:) "The report, entitled "Trusted Computing: Promise and Risk," maintains that computer owners themselves, rather than the companies that provide software and data for use on the computer, should retain control over the security measures installed on their computers. Any other approach, says the report's author Seth Schoen, carries the risk of anticompetitive behavior by which software providers may enforce "security measures" that prevent interoperability when using a competitor's software."

The report explains that:

"Our most fundamental concern is that trusted computing systems are being deliberately designed to support threat models in which the owner of a 'trusted' computer is considered a threat. These models are the exception rather than the rule in the history of computer and communications security, and they are not part of the rationales for trusted computing publicly offered by its proponents."

The first case of homosexual necrophilia in the mallard Anas platyrhynchos
On 5 June 1995 an adult male mallard (Anas platyrhynchos) collided with the glass façade of the Natuurmuseum Rotterdam and died. An other drake mallard raped the corpse almost continuously for 75 minutes. Then the author disturbed the scene and secured the dead duck. Dissection showed that the rape-victim indeed was of the male sex. According to a series of memoranda our office obtained today, Arnold Schwarzenegger's dalliance with boys in a hotel room just two years ago is every bit as scandalous as his manhandling of women during his career as celebrity he-man.

Schwarzenegger knowingly joined the hush-hush encounter as part of a campaign to sabotage a Davis-Bustamante plan to make Enron and other power pirates then ravaging California pay back the $9 billion in illicit profits they carried off.

This is about a billion times larger than anything demonstrated previously. ... The plan goes like this. Suicide Webcast Killed
The webcast of a concert by Florida band Hell On Earth that was supposed to occur this past Saturday night (October 4), and feature a live suicide, did not happen, according to the Associated Press. The show and suicide were both scheduled to be broadcast on the band's website from two separate, secret locations, but the site was brought down Saturday night by a flood of data from computers in Hong Kong.
